I've thought about it for a good while and I think something should be done even if it's as small as his IPS shutting him down.
One of the new pictures that he made had two actors in it from those "Target" store commercials. He put one of the names of one of the members of the web board I'm a part of on it with photoshop and it involved the initials _ _ _ _ _ _ I don't know exactly what that stands for but from the way the picture looks it has to do with children and there is a child actor in the picture with a man. Wonder if Target would like to know this information? ;)
I may not have the money to sue this guy but I'm sure they have a great legal team that does as well as the actors portrayed in this picture. I'm thinking about writing them with a link to the picture that he has up as I would think they CAN prove libel as they are a store chain who's busines could possibly be hurt by the photo....

I suspect his use of their copyrighted material does not constitute fair use! Statutory fine?

FYI, NAMBLA= North American Man-Boy Love Association. Yes, that's exactly as creepy as you think it is.

Eve,

I dont mean to sound insensitive, but I think you should just chalk it up to bad taste and move on. We already live in a society that is in my opinion overly litigious. Why add one more frivalous lawsuit to the docket? Sure, the person who did it lacks a socially acceptable sense of humor, but was it that bad? Its not like they put your face on a dead or mamed body or something, which could be considered a threat. All they did was put your face on somebody's body who was involved in an abnormal sex act. Is that REALLY worth going to court over? Probably not the first porn you've seen on the internet, damn sure wont be the last.

The other thing is, you should not be posting your picture on the internet if something this minor is going to offend you to the point where you feel like you were "raped" online. I assure you, I know women who were raped, and you arent one of them. I'm sorry, but I could tell you exactly what I would do, or any one of my friends would do in your situation.

1. Laugh like hell that someone would bother to waste enough time to make a pic like that come out that good, and feel "flattered" that they felt that "highly" of me to make me their subject.

2. Say the word "A$$hole" out loud in a laughing voice.

3. Hit the delete key and move on to the next item.

I dont want to be the bad guy, but somebody has to say it.
Get over it, life's too short to sweat the small stuff.

UPDATE UPDATE UPDATE!
Well, the image hosting website was very friendly and able to work with me on this issue.
I now have the guys real name, address, and phone number.
The address he used for billing purposes on the image hosting site was a P.O. Box. He used his real email address.
I cross referenced his email addy with email addys on the internet web board I'm a part of and BINGO I found out who it was. I then found that he sell things online and was DUMB enough to list his phone number on his website.
I cross referenced his real name and did a phone search. Then I was provided with his HOME address, and phone number that matches up to the phone number he listed online.
I then went to a site that list the various online cybercrimes that you can charge a person with. You can file a report and the states attorney and F.B.I can look into the matter.
I can file a report for obsenity laws, stalking, and harassment. (This same guy has followed me around on various message boards)
The sad thing is...I don't even know him. I've never spoken to him, nor have I met him. He's doing this to be accepted by his "friends" who don't like me.
This guy left a paper trail long enough to write Moby Dick on. ;)
The other two members of the board I'm speaking of may join forces with me as they were violated too, and then retain a lawyer with me.
From what I understand the police department has an internet crime team. I can also file a report with them and have their team look into the matter and see if they have anything they can charge him with.
Wish me luck!

YES IT WAS that bad! I am not overly insensitive. I can deal with and have delt with a lot in times past on the net, however I am being harassed repeatedly and will not tolerate such abuse. Yes, it is worth going to court over. This is not a frivelous lawsuit. It's easy for one to judge unless it's their wife or sister being stalked and harassed. You have no clue what this guy has been up to, and it's not just pictures, it's calling friends homes, talking to their KIDS! This man needs to be stopped because quite frankly, I'm concerned that he may hurt someone. If the victims he is harassing allow him to get away with this, I feel it's a matter of time before he acts out on some of his twisted ideas in the real world.
Anywayz, this situation is well under hand. I just wanted to give everyone an update that everything is going along just fine.

Regarding this issue, I believe Eve is right to pursue legal action, and any other actions that will punish this lowlife.

Just because the act of harrassment was perpetrated online should not diminish its illegality. As the lines between real and cybersociety become more indistinguishable, people need to realize that a crime carries the same weight, regardless of 'territory'.

Should someone who hacks and steals from online financial accounts be treated less severely than if he would have robbed a blank in broad daylight? Of course not.

I would suggest to extrapolate from the 'real' world you legal options. Do not contact this scumbag in real life (resist temptation, plus it could really be dangerous to be a cybervigilante) - use only legal recourse in order to ensure that you don't pop up as a legal counter target.

The key difference here would be that physically robbing banks usually involves the threat of violence. So, yes, they would be treated differently, considering likely "real world" scenarios.

I think I'm in the move on crowd, unless, of course, you feel your safety being threatened.

way to go Eve!

nice work in tracing the fellow, it makes it much easier for the police to now continue in formally charging him with the various offences he's committed. from their perspective, all they have to do is confirm the information you've given them, and they're good to go, rather than "invest" time in investigating from scratch.

my concern would be if the police decline to file charges. if so, you'll need to think very carefully about whether or not the financial outlay in pursuing civil action is worth it. lawyers are expensive, and even if you succeed, if he's broke, or made himself judgment-proof, you're out of luck.
