I still think this is the equivilent of saying that music is public domain unless the listener deems it worthy of paying for.

Not if the same music is for sale and somebody doesn't buy the album because they downloaded it. When my band releases our CD, I would HATE for people to be downloading it for free if I have a case of them just sitting there.
