Actually I think you're probably right on that one (I haven't seen it myself)and could easily see that nomination being the result of aggressive marketing by Weinstein which is the reason why many people believe Shapespeare in Love beat out Saving Private Ryan.

I don't think the Academy should necessarily be obligated to reflect the critical reception of movies, especially in regards to RT percentages which don't tell the whole story. How many of the 90-plus percent of critics who approved of TDK actually thought it was a truly great, flawless film...
