I think it boils down to there being no proof or even allegations that he ever did anything other than tell bad jokes on twitter several years ago and it being highly unlikely that Disney didn't know about them before they hired him to begin with.
Disney's biggest problem is that they reacted way too fast to the controversy. There is no way they thought that Gunn would get as much support as he has.

I'm not sure it was the best move to include Sean Gunn in the letter but other than that I am OK with it. It make it look a little like Sean held them at Gunn point.
Just got back from seeing this, liked it but it wasn't even close to being as good as the first one. I think they set the record for most post credit scenes. At least 5.
