What "extra something" does Swing Time have to make it into the Criterion collection, but not Captain Blood?
The apex of a genre (Astaire Rogers.) Amazing timeless songs. Director George Stevens. On the Library of Congress National Film Registry list. On AFI's Top 100 list. There's a timeless energy about it that will be mentioned every time a compilation of the most iconic moments in cinema history are compiled.

They released The Blob, Night of the Living Dead, The Great Escape etc. I know they don't exclusively release "art films" but I can make a case for many of those more than that particular Warner Bros. title. I would NOT be saying that if they close The Adventures of Robin Hood, or even Yankee Doodle Dandy.
If Criterion could release Armageddon they're capable of releasing just about anything.

Captain Blood, the first screen pairing of Errol Flynn and Olivia de Havilland as well as Erich Wolfgang Korngold, one of the first Hollywood movies he scored that launched his Hollywood career and changed the way movie scores were done. All three became Hollywood legends after the success of this movie. Furthermore, it was directed by Michael Curtiz, one of Hollywood's greatest directors.

The plain truth is that Captain Blood and O Lucky Man are the only movies left from this list of WB DVDs that went OOP in 2017 that haven't been released by Criterion... yet.

The Roaring Twenties
The Philadelphia Story
Pat Garrett & Billy the Kid
O Lucky Man
Lone Star
Hedwig & The Angry Inch
Captain Blood
Bringing Up Baby
Arsenic and Old Lace

also...

Mean Streets
Barry Lyndon

That was 1999. 25 whole years ago. I forgive them for that "mistake" but that was concurrent with their Laserdisc days where it was all about the director approved transfer, bonus material/supplements on the second disc, etc. Besides Bay's The Rock, I can't think of any other films in their library (or was they're both OOP) that are similar.

SOooo... if Criterion would actually get Captain Blood, do we need to wait however to hear (the rumor) that's likely the case and then maybe another 5-10 years before they actually release it (like has often been mentioned about their slowness)? ;)

Everyone seems to want Fred and Ginger. I would assume that the original elements are long gone, so would any Blu-rays (other than the one we have) be any better than the DVDs?
One film that seems to be overlooked is Anthony Adverse. With March and DeHavilland and a Korngold score it's a wonderful saga (157 minutes).

There's never really been a solid answer for the question of why any given film is considered Criterion-worthy. And I'm not sure that's a bad thing. Regardless of what any one of us might think of a specific film, if Criterion releases a film on LD/DVD/BD/UHD, there's obviously a reason why they chose it (even if it's because Michael Bay was groveling and begging them to release some of his films ;) ).

The funny thing here?

Criterion released Swing Time on LD back in the day, just as they did the perhaps Criterion-unworthy (sorry, Michael) Scaramouche and The Adventures of Robin Hood.

Thankfully this list was accurate. 'Round Midnight was on my most-wanted list since the inception or Blu-ray.

The original NY Times review of its first performance in New York I think you'll find very interesting.
