Yes, there are drawbacks, such as increased bureaucracy, difficulty in enforcement, and that not every spammer will be fined; but the concept of "if you spam, you're in trouble, bar none" is one that needs to be accepted across the board.
I also like the prospect of limiting cookie information to track where you go, although there are aspects of that that are in the user's control as well.
This is by no means a flawless action, but it's a start.
Then again, who is the government to stop those Nigerians from asking me to help them get their money to them?
