Not to take away for the OAR protests, but wasn't LOTR shot in Super 35? Isn't it possible they simply allowed for more image at the top and bottom? If so, that should not be labeled as "pan-n-scan" or "cropping".

It looked like it was cropped to me. Whether it was Super 35 or not, it didn't appear to be open matte.

Super 35 reformatted typically offers more information at the top and bottom of the frame but loses information on the sides. Also, and I'm not sure how this applies in the case of LOTR specifically, but many special effects-heavy movies don't have the effects done at 4x3, and shots with CGI are cropped. In case the case of LOTR, if that's what they did, that'd be an awful lot of the movie.
