Brian - the other point is, what is the person guilty of?

Let's say a guy drives after consuming alcohol, has an accident, injures someone, and knocks down a fence. That could be careless, negligent, or reckless behavior (those are all degrees of culpability), it could be a property damage crime, it could be DWI at a misdemeanor level, it could be DWI at a felony level, it could be felony-level assault because it was committed with a vehicle, or felony- level assault based on the injury to another person, or worse. What if the roads were icy and slick? What if the alcohol was two cans of 3.2 beer, consumed three hours before, and the driver is a 240 pound man? What if it was a clear sunny day and the fence he ran down is at the home of someone he has bad blood with? What if the alcohol was a smash pack? What if he is on medication that he knows mixes badly with alcohol?

All those factors are relevant to quasi-criminal, criminal, or civil litigation, and are critical in determining what burdens of proof can be met and what should be charged.
