Except they're wrong because the Beatles catalog will not be available.

But do the Beatles' albums fall under EMI or Apple?

I believe the performances themselves (as opposed to the song rights) are owned by Apple and licensed to EMI. All major Beatle/Apple decisions require a unanimous vote from Paul, Ringo, Yoko and Olivia. Don't expect to see the Beatles catalogue available (legally) for download anytime soon.
