I was able to come across an open box Directv HD receiver for a very cheap price and was wondering if I could use it as a stand alone OTA unit ?

I believe you can. I have a friend who has a DTC-100 and does not have DirecTV. He does exactly what you are looking for.

Yes you can, but alot of retailers now require an agreement from DirecTV that will charge you an extra $150 if you don't activate service within 30 days. If you don't have to sign one, then you are good to go.
