I've seen the pictures. They are readily available on the Internet. As always, she looks beautiful and the pictures are just standard paparazzi fair. Nothing tasteless or revealing. Also, Penthouse is going bankrupt so I doubt they care too much about lawsuits right now.

What a world we live in when otherwise decent people would condone the willful invasion of a young woman's privacy by supporting a magazine that publishes such photos against her will...uh...what date does the June issue street again? :D

Is it legal to publish nude photos that were taken in a public setting, such as a nude beach?

I don't think "journalists" have to obtain permission to take "news" photographs, and yet still be legally allowed to publish them.

In particular, I remember an incident in the early '90s in Boulder, Colorado. A local newspaper photographer took pictures of women who went topless to a protest rally (in response to the Persian Gulf War that was going on at the time). One notable difference: there was little prurient interest in seeing those particular women baring their breasts. They were not famous for their looks.

The pictures were published in the paper the next day. Some of the women who went topless at the protest threatened to sue, but they apparently had no grounds for a lawsuit. They went topless in public, and had their pictures taken in conjunction with news reporting about a Gulf War protest.

Now it's a completely different story for paparazzi-style photographers to skulk around nude beaches looking for celebrities to photograph in the buff ... but if said celebrity goes nude in a publicly accessible nude beach, haven't they forfeited their privacy?

I think that's why they say: Don't do anything you wouldn't want printed in the paper!

I believe you are correct in your assumption that the right to privacy for celebs is thrown out the window when they are out in public, including nude beaches. However, these particular pictures were taken from her backyard in Florida where she was sunbathing. If I recall correctly, she built an entire wall for her property after these pictures came out.

As for the pictures, they are purely topless shots with her dog and entourage. The pictures were released onto the Internet by the photographer many months ago. It's possible that he held onto a few negatives so that he could sell them to a magazine but I think Penthouse is just reprinting what's already out there.

these will be pictures different than the ones currently circulating the internet. Of course, I'm no authority so I could be wrong. But here's to hoping I'm not. :)
Oh, and to those asking for Britney Spears, I'm actually hoping Playboy waits until they can reach an agreement with Britney, Christina and Jessica Simpson to do a triple feature. :D

If it is the ones that have been circulating, it's really not worth people's hard earned cash.
However if they're all new (and better quality) shots...
