Monster cable apparently sues every company or company with a product with the word monster in their name.


Monster Cable Strong-Arms Small Businesses Again

For those who remember Monster Cable Products Inc. vs. Mike Shkolnik, dba Mad Martian in the summer of 2002, where the attorneys for Monster Cable attempted to wrest control of the domain name, monster.biz, i.e. Info, they are at it again. This time, against a small business selling vintage clothing, http://monstervintage.com

In the case of Monster Cables vs. Mad Martian / monster.biz, Monster Cable received a lot of angry emails, as well as mail containing receipts of returned Monster Cable products. This must have had an effect on their decision to ultimately drop the case.

I understand that Frankenstein, Wolfman, and the Mummy have launched a class action suit representing all current and former Monsters, and retained Johnny Cochran to sue Monster Cable Inc. for trade mark infringement and restriction of trade:D

Seriously, I find it amazing that these cases could possibly advance to trial, and consider it an unfortunate commentary on the law suit happy nature of our society.

Shakespear had it right re:lawyers.

Wow...this is even worse than the Spike Lee/Spike TV thing.

Since when do people think they deserve exclusive use of words like "spike" and "monster"?!

Actually, reading more about it seems Monster Cable's real MO is to shake down licensing fees and 1% of gross from these companies.

"I received a phone call from the attorney and he stated because I was using the word "Monster" I would have to sign a license to continue to use the Monstervintage.com name. Logo or design issues were never mentioned or I would have dealt with it). Then he continued with informing me that they get paid and sell their license and how much money could I come up with, I told him that MonsterVintage.Com is a small cottage business and has a limited budget. Monster Cable's Attorney then asked if I could come up with $1000.00. And then went on to say they also required 1% of the gross business yearly income. Of course, I did not agree with this strong-arm tactic and did not pay or sign the huge license agreement that was sent after that phone converstion, 1 1/2" thick License Agreement of pure legal trickery that was received around 5/2002. Luckily Hasbro will continue to publish the Dungeons & Dragons Monsterous manual. Creature compendium doesn't have the same ring to it.

How can you go after the Chicago Bears for their Monsters of the Midway moniker?

Absolutely. I have no sympathy for anyone with the stupidity and lack of foresight to chose such a generic name for their enterprise.

That is just crazy! The only one on that list that I can see Monster having a valid claim against is No. 63 since it appears they are selling the same product.

attorney robert payne and monster inc. should keep their hands away from Barry Dean Rogers' One-Eyed Monster. ;)

And what about Monster's, Inc. Are they going to try and sue Disney/Pixar for using the name?

Just F'ing ridiculous.

I would bet Disney's attorney's would make mincemeat of Monster Cable's lawyers. Actually, I kind of wish they would go after 'em.

That would get huge publicity, and expose Mr. Lee and company to a much wider audience for what really they are.

Monster cable like all fancy packaged audiophile brands have nothing to do with value vs performance. I like making my own with Belden or Canare at down to earth prices. Noel can find his money from elsewhere.:D
