Though you can never be too cautious, this guy was probably legit with having blacktop to sell. Usually if they have a big job (repaving a street) there is enough left over blacktop to pave some local driveways.

Of course usually when they try to offload blactop this way it is a sub-par laying with very little preparation and not usually on the thick side.

Like Justin, I was going to suggest that this guy was not a burglar casing the area in broad daylight - but unlike him I was not going to suggest he was "legit". Scam-artists often pull this "we have some material left over from a big job" con to fool the unsuspecting into paying ridiculous "bargain" prices to have cheap substandard or even counterfeit paint, asphalt, concrete and other building materials applied to their homes. Most legit businesses charge more than enough to cover thier excess materials and it is rarely worthwhile for their employees to solicit business door-to-door on the way home. (Guys who moonlight with the boss's stuff usually use the material at their own homes or their friends' and they schedule the work in advance.)

That could be another explanation for his being pulled over as well. Most police depts. know to keep an eye out for these scams. They're very popular here in Florida where the elderly make good targets.
