Is Alexander Korda's "Thief of Bagdad" out of copyright, at least in the U.S.?

No, the North American distribution rights to the London Films/Korda library are currently in the hands of Janus Films (Criterion).

I recommend at least renting the Criterion release if you have not seen it. Looks quite good for it's age.
