Is Mr. Peabody and the Mermaid a public domain title? if not is there any chance of seeing it on DVD?

I'd love to see this released on DVD as well, but I think it's part of the Republic package owned by Lionsgate and they've done very little with the Republic library.
I recently bought a colorized Republic VHS tape of this for one dollar at a library sale. It's a charmer with great performances from William Powell, Ann Blyth, Fred Clark and the lovely Irene Hervey.
