When i started watching the new medium boxset i was suprised to see that the Dolby Digital track was flagged for EX. I wouldn't have expected a tv show to be Dolby Digital EX but my receiver turned the 6.1 on as soon as the episode started.

I found nothing to indicate that those movies listed had EX/ES audio on DVD. Sorry Mike, the studios don't always follow the rules on converting theater released EX/ES movies to DVD EX/ES releases.
Other than that I listed Running Scared on the list. So far, none of the HD DVD or Blu Ray formats have released movies in EX/ES. They have enough problems getting the standard formats right it seems.

If these three movies aren't ex-encoded on DVD, then as far as I know, they are the only three theatrically ex-encoded movies that aren't. It seems highly unlikely to me that a studio would remix a new release into fewer channels. I would be very surprised if, maybe aside from level adjustment, there was any remixing done at all.

All the Lions Gate films on Blu-ray have been remixed into DD EX and DTS-ES.
"The Perfect Storm" lists a 5.1 Dolby Digital EX (plus) on HD DVD.

If the theatre is properly equipped, this shouldn't be happening. How do I know? I used to work at a 14 screen multiplex with 4 screens equipped for DD EX. If the processor did not detect an EX flag, it would decode as 5.1 or whatever the format of the sound was (Woody Allen's films are apparently released in 1.0 DD mono). As well, if surrounds are collapsing into the back centre track, that's an indication of shoddy mixing.
