What must you disclose when trading in a used car?

We recently traded in my wife's 8 year old car and bought her a new one. In addition to some minor issues with our trade in, the air conditioning was shot. I mentioned the A/C issue to the salesman because I believe that was the right thing to do, but I was wondering what one legally has to disclose as far as the condition of the car.

They asked me the standard "has this vehicle been in an accident" questions. But they never asked about any mechanical problems.

If I hadn't disclosed the air conditioning issue, I don't know if they would have figured it out since it was about 35 degrees out that day. Maybe they would have, I don't know.

I don't disclose anything unless they ask. They don't disclose any issues if I am buying a used car. Fair is fair.

I bought a used 96 Jeep Cherokee from a dealership and when the weather got warm I figured out that the A/C didn't work and other signs pointed to it being a flood car. After I had had it for awhile, I found that there were stains in the back carpet and traces of sand in the coolant.

I bought in in for repairs at the same dealership and after much discussion they agred to split the cost of the A/C repair without admitting that they had sold me a lemon. That repair did not correct the problem and I spent almost $1,000 to try to fix it.

I continued driving it for two years, sweating it in the summer all the while vowing I would never buy another car from them until I had had enough and began shopping for another car. I found a new Grand Cherokee at their dealership in another city and had it transferred there, it was the right price and options and, you see, I had begun to have some other problems with it and the day I drove it down for the trade-in, it wouldn't start after stopping for $2.00 worth of gas I put in to get me to the dealership, I wanted the tank empty and had to get out and jiggle the battery cables to get going. I parked the old one and drove the new one off the lot. To this day I don't know if the junker cranked after I left.

They sold me a junker and I traded in the same junker two years later right back to them, karma can be such a bitch.

I know enough to know I don't know enough!

They inspect the car. You dont have to tell them anything. If they miss it its their fault. Most cars older than 4 or 5 years dealerships just auction off as-is anyway. And with that being the case they probably wont tell whoever they auction your wifes car off to about the A/C.
