is there any games out yet that actually use DD 5.1 sound? i heard there are a few in teh works. what about any other software that can utilize the spdif output to send a 5.1 bitstream?

None. Absolutely none. The nearest thing is that is going to have the capability to produce 5.1 Dolby Digital audio output on the fly is the X-Box. I know of one game one the PS2 that has 5.1 DD audio during the cutscenes made by Square, but as a rule, the PS2 cannot produce 5.1 DD on the fly. PS2 games have to have 5.1 prerecorded.
The interesting thing is Nvidia created the audio processor on the X-Box, and they have just announced that they are entering the chipset market. They already stated they are going to adopt there audio processor technology to their upcoming chipsets. So maybe in the near future we may see mainboards with onboard audio processors cable of delivering 5.1 3D positional DD audio on the fly. But this is still at the very least a year away for the PC market.
